Case-law concerning the disclosure of information by public authorities 

On 31 March 2022, the Supreme Administrative Court of the Slovak Republic issued a judgment under Case No. 5 Sžik 5/2020 concerning the disclosure of information pursuant to Act No. 211/2000 Coll. on Free Access to Information and on Amendments and Additions to Certain Acts

The Supreme Administrative Court of the Slovak Republic said that it is up to the obliged person to prove the applicant's intent to abuse the law, "[...] beyond all reasonable doubt, because the refusal of information on the grounds of abuse of the right is to be understood as an ultima ratio solution and as a restrictively constructed exception to the constitutionally guaranteed right of access to information."
